Terms of Service
These terms govern your use of Vesper, operated by Lionshead Digital (“Vesper,” “we,” “us”). By creating an account or using the service, you agree to them. Last updated July 11, 2026.
The service
Vesper is software that helps you research and evaluate tax-sale and related property opportunities: it ingests public tax-sale lists, analyzes parcels, and produces ranked, annotated diligence output. It may also offer a service to help recover tax-sale or foreclosure surplus (“overage”) funds. Vesper provides information, analysis, and workflow tools; it does not make decisions for you.
Not professional advice
Vesper is an information and analysis tool, not a substitute for professional judgment. Nothing in the product is legal, financial, tax, investment, title, or real-estate advice, and no output is a recommendation to buy, bid on, or avoid any property. Tax-sale and surplus investing carry real risk, including loss of your entire investment, redemption of properties you bid on, title defects, and liens. You are responsible for your own due diligence and for consulting qualified professionals (attorneys, title, tax, and financial advisors) before acting. Our data comes from public and third-party sources and may be incomplete or out of date; we do not warrant its accuracy.
Accounts and eligibility
You must be at least 18 and able to form a binding contract. Keep your login credentials secure; you are responsible for activity under your account. Provide accurate information and keep it current.
Subscriptions and billing
Paid plans are billed through Stripe on a recurring basis (and, on mobile, through the app store’s in-app purchase system). Unless stated otherwise, subscriptions renew automatically until you cancel, and cancellation takes effect at the end of the current billing period. Prices may change on notice. Except where required by law, fees are non-refundable.
Surplus / overage-recovery service
If you engage Vesper to help recover surplus funds, additional terms apply and are set out in the engagement documents you sign:
- You can pursue these funds yourself, for free. Surplus funds can typically be claimed directly from the county or court at no cost. Our service is an optional convenience, not the only way to recover your money.
- Contingency fee. Our fee is a percentage of funds actually recovered (25% unless your signed agreement states otherwise). If nothing is recovered, you owe no fee.
- We are not a law firm.Vesper does not provide legal advice or legal representation. Where a claim requires legal work, it is handled by a licensed attorney, and any recovered funds are disbursed through that attorney’s trust (IOLTA) account. Vesper never takes possession of your funds.
- Authorization. The service operates under a limited authorization you grant in the engagement documents. You may cancel as described in those documents. We make no guarantee that any particular claim will succeed or of the amount or timing of any recovery.
Acceptable use
Use Vesper lawfully. Do not scrape, resell, or redistribute our data or output except as your plan permits, attempt to breach security or another customer’s data, reverse-engineer the service, or use it to harass or defraud anyone. We may suspend accounts that violate these terms.
Intellectual property
The software, models, rankings, and site content are owned by us or our licensors. You keep ownership of the data you put in; you grant us the rights needed to operate the service for you.
Disclaimers and limitation of liability
The service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. To the extent permitted by law, Vesper and Lionshead Digital are not liable for indirect, incidental, or consequential damages, or for investment losses, and our total liability is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Governing law and changes
These terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. We may update these terms; we will change the date above and, for material changes, notify account holders, and your continued use means you accept the updated terms.
